Werden iPods in der Schweiz bald teurer?

iPod Das Schweizer Bundesgericht hat eine Beschwerde von Konsumentenschutzorganisationen gegen die Einführung einer Urheberrechtsabgabe auf MP3-Player abgewiesen. Es ist damit zu rechnen, dass MP3-Player und Harddisc-Rekorder dadurch teurer werden.

Die Gebühr hängt in erster Linie von der Speicherkapazität der Geräte ab. Bei iPods mit Festplatte liegt die Gebühr bei rund 47 Rappen pro Gigabyte, dies entspricht knapp 38 Franken für einen iPod mit 80 Gigabyte Festplattenkapazität. Bei Chipkarten beträgt der Tarif maximal zwei Rappen pro Megabyte (dies entspricht 20 Franken pro Gigabyte). Auch Videorekorder mit integrierter Festplatte fallen unter diese neue Gebühr und dürften bis zu 90 Franken teurer werden.

Während die Verwertungsgesellschaften auf noch höhere Tarife pochten, legten vier Konsumentenorganisation Beschwerde gegen die neue Gebühr ein. Mit diesem Anliegen sind die Konsumentenorganisationen nun aber abgeblitzt, weil nicht belegt sei, ob die Konsumentenorganisationen wirklich im Interesse der Konsumenten handelten, so das Bundesgericht.

Die Gebühr wird ab dem 1. September 2007 erhoben, die Tarife werden frühestens nach 22 Monaten angepasst. Für die Bezahlung der Gebühr müssen die Hersteller aufkommen, welche Auswirkungen dies auf die Endpreise haben wird, bleibt abzuwarten.

Ich dachte ich hatte nicht gut gehört… Aber es stimmt!!

Demnächst werde ich an Musik Labels schreiben: “Dear Label, thank you, Switzerland introduced a tax on music playing devices, in order to get paid for the (supposed) violation of copyright. I have been a legal music purchaser for more than a year now. With the introduction of this tax I will be paying twice as much royalties for my songs, in case I decide to purchase them legally online. In order to avoid double payment I will revert to P2P downloading, so that I don’t have to pay copyrights twice. In fact I would like to thank you, because this initiative helped me get the answer to two things: - 1) donwloading music from P2P services for FREE is not illegal, provided I pay an added tax for the device - 2) for a couple of bucks I will be able to purchase WAY more content, making the whole a lot more convenient for me

There is however a further question that your issue arises… In case I put my own content (music, movies and pictures) on the device, whom do I have to ask to get my royalty money back? Since I am also producing copyright protected material, I think part of that money should be sent back to me.

Thank you very much for this great initiative in favour of a clearer and more legal marketplace.

Please send me a receipt of the sum you paid to the judges in Lausanne’s supreme court to rule in your favour and with such a disrespect of legal consumers as I am.
